Assembly Proceedings, November 1, to December 20, 1765.

An Act to vest the Title of and in Certain Lands in John Hammond Esquire and for other purposes therein mentioned. Whereas Ann Ogle of Annapolis Widow of Samuel Ogle Esquire Deceased. Benjamin Tasker Esquire and John Hammond Esquire have by their petition to this present General Assembly Set forth" that the said Samuel Ogle died Seized in fee of and in two Several Tracts of Land in Ann Arundel County called or known by the Names of Hickory Ridge and Green Land; the former containing two hundred and Sixty two Acres more or less, the latter one hundred Acres more or less : That Benjamin Ogle Son and Heir at Law of the said Samuel Ogle, to whom the said tracts of Land have descended being a Minor and incapable to Sell and convey the said Lands. The Annual Charge of Quit Rents without any Profit from the said Lands to answer the same is a Burden upon the other Estate of the said Minor. And that the said Ann Ogle Mother and the said Benjamin Tasker Grandfather and Guardian of the said Minor, and also Executor of the aforesaid Samuel Ogle deceased, conceive that it would be for the Advantage of the said Minor to have the said Lands Sold and the Money arising from such Sale put out to Interest for his Use: That the said John Hammond hath agreed to and with the said Benjamin Tasker, to whom the Care of the said Minor during his Minority hath been committed to give and pay for the said two Tracts of Land the sum of one hundred and fifty pounds Sterling in Case the Right and Title of the said Benjamin Ogle in and to the said Lands, clear of, and discharged from all Dower and claim of Dower of the aforesaid Ann Ogle, may be Vested in the said John Hammond:" And Whereas it appears to this general Assembly, on consideration of the Matters in the said Petition contained and of the Report of the Committee appointed to examine into the Tracts alleged therein; That it would correspond with the general Scope and Intention of the last Will and codicil thereto of the said Samuel Ogle, Esquire deceased, and be conducive to the Benefit and Advantage of the aforesaid Benjamin Ogle, Son and Heir at Law and Devisee of the said Samuel Ogle: That the Prayer of the said Petition be Granted.

Be it therefore Enacted by the Right Honorable the Lord Proprietary by and with the Advice and consent of his Lordships Governor and the Upper and Lower Houses of Assembly and the Authority of the Same, That upon the payment of the sum of one hundred and fifty Pounds Sterling Money by the aforesaid John Hammond to the aforesaid Benjamin Tasker according to the Terms of the Agreement between them in that Behalf made and in the said Petition mentioned, The Right, Title, Interest and Estate of the said Benjamin Ogle in and to the Lands aforesaid, and each of them and every part and parcel thereof with their and every of their appurtenances, shall in Virtue of this Act be effectually transferred to and vested in the said John Hammond his Heirs and Assigns, clear of and exempted and discharged from all Dower Right, Title claim and demand of Dower of the said Ann Ogle, in, of or to the same, and any and every part or parcel thereof, according to the prayer of the said Petition. And

Be it enacted by the Authority Advice and consent aforesaid. That as Soon as conveniently may be after the Receipt of the said sum of Money the same to be put out to Interest by the said Benjamin Tasker, for the Use and Benefit of the said Benjamin Ogle, until he shall arrive at or attain his full age: And that the saidPrincipal and Interest which shall or may arise or accrue thereon, shall be accounted for, and paid and Satisfied by the said Benjamin Tasker his Executors or Administrators to the said Benjamin Ogle, when the said Benjamin Ogle shall arrive at or attain his Age aforesaid: or in Case the said Benjamin Ogle should die in his Minority, to the Heir at Law of the said Benjamin Ogle.

And Be it Enacted by the Authority advice and Consent aforesaid That upon payment of the said Sum of one hundred and fifty Pounds Sterling Money by the said John Hammond to the said Benjamin Tasker, the said Benjamin Tasker shall make and execute a Receipt in Writing under his hand therefore Attested by two or more Witnesses, and the same Shall acknowledge to be his receipt before someone Provincial Magistrate which Receipt and the acknowledgment thereof, the said John Hammond may procure to be entered of Record, among the Land Records of the Provincial or Ann Arundel County Court And the said Receipt and Acknowledgment aforesaid or the exemplification of the Record thereof under the Seal of the said Court where the same shall be enrolled shall be forever hereafter Sufficient Evidence to prove the Payment of the said Sum of Money by the said John Hammond to the said Benjamin Tasker
